  1. Residency requirement. You can satisfy New York’s divorce residency requirement in one of three ways:  

  • Before filing the divorce papers, either you or your spouse has been living in the state for at least two continuous years. 

  • Both you and your spouse are currently living in New York, and the cause of your divorce happened in New York. 

  • You or your spouse has been living in New York for at least one continuous year before the filing date and you got married in New York, you lived there as a married couple, or the cause of your divorce happened in New York. 

  1. Agreement on the no-fault reason for your divorce. The most efficient way to get started with your uncontested divorce is to make it clear that the breakdown of your marriage is irreparable, and has been that way for at least six months.
